In a dazzling display of constitutional gymnastics, the Supreme Court has decided that nationwide injunctions—long used to temporarily stop presidents from turning democracy into a monarchy—are just too powerful for those pesky lower courts.
In a decision that screams, “We miss the monarchy,” the Supreme Court ruled 6-3 that federal judges are simply too nosy and must stop enforcing the Rule of Law every time a president tries to rewrite the Constitution with a Sharpie.
The case revolved around Trump’s bold and very subtle plan to redefine what ‘born in the U.S.’ means—specifically, to exclude babies born here unless they have at least one parent with a green card, citizenship, or the correct shade of political affiliation. In short: “No citizen babies without proper paperwork, please.”
The court didn’t say Trump’s order was legal (because it’s not), but they also decided that judges shouldn’t be allowed to stop it everywhere, just in the ZIP codes where people actually sued. Because why have a Constitution when you can have patchwork rights that expire at state lines?
The six are not what I would call conservative because they are not conserving the rights of all the people. Just a few. I’m certainly not saying that they are liberal … but there has to be a term that describes them accurately. I’m thinking … oh yeah! Undemocratic. That’s the one.
